OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of being thrown from an all-terrain vehicle during operation: On or about September 3, 2015, and other times prior thereto, employees operating an all-terrain vehicle (ATV) on public roads were exposed to the hazard of being thrown from the ATV.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment: At this establishment, a hazard assessment was not performed to determine the requirement or need for personal protective equipment such as, but not limited to, protective helmets for operators of an all-terrain vehicle. Employees were exposed to head injuries when operating the all-terrain vehicle.
