Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from high pressure hydraulic fluid:    (a)    On or about August, 18 2015 for an injured employee exposed to struck-by hazards from high pressure hydraulic fluid while testing a hydraulic cylinder at or near 3630 Miriam Avenue in Bismarck, North Dakota.   Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard would be to adhere to the ANSI T2.24.1, Hydraulic fluid power- Systems standards for stationary industrial machinery that refer to SAE J1273 which states If a pressurized hose assembly blows apart, the fittings can be thrown off at high speed, and the loose hose can flail or whip with great force. This is particularly true in compressible-fluid systems. When this risk exists, consider guards and restraints to protect against injury.,  A hose fitting program may reduce equipment downtime, maintain peak operating performance, and reduce the risk of personal injury and/or property damage. The maintenance program includes visual inspection, functional test, hose storage, and age control.  Persons fabricating hose assemblies should be trained in the proper use of equipment and materials.  The manufacturer's instructions and the practices listed as follows must be followed. Properly assembled fittings are vital to the integrity of a hose assembly. Improperly assembled fittings can separate from the hose and may cause serious injury.

Section (5)(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to crushing hazards from tilted truck cab:   (a)    On or about August, 3 2015 for an employee who was injured when a tiled truck cab fell on him while removing a  CAC Cooler where the safety pin was missing at or near 3630 Miriam Avenue in Bismarck, North Dakota.  Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard would be to adhere to the GMC truck T series user manual by using safety lock pin or using secondary stand that designed to be used with tilted cab to insure that the cab is securely locked in position and will not move according to ASME PALD 2009.
