29 CFR 1926.1408(a)(2): 29 CFR 1926.1408(a)(2): The employer did not determine if any part of the equipment, load line or load (including rigging and lifting accessories), if operated up to the equipment's maximum working radius in the work zone, could get closer than 20 feet to a power line:    (a) Jobsite, Armory Drive, Everett, PA:  On or about September 8, 2015 the employer did not determine if any part of the equipment, load line or load when operated up to the maximum working radius in the work zone could get closer than 20 feet to a power line.  An employee suffered a fatal electrical shock when the crane cable came in contact with an overhead power line as the employee handled the hook to rig up a load.

29 CFR 1926.1408(g)(1): The employer did not train each operator and crew member assigned to work with the equipment on all of the hazards of working around electrical power lines that included the hazards listed in (g)(1)(i) A-F:    (a) Jobsite, Armory Drive, Everett, PA:  On or about September 8, 2015 the employer had not trained the operator and crew members working with the crane on the hazards of working around electrical power lines that included, but is not limited to: the procedures to be followed when an electrical contact with a power line occurs, the danger of electrocution from the operator simultaneously touching the equipment and the ground, the importance of the operator's safety of remaining inside the cab except where there is an imminent danger of fire, explosion, or other emergency that necessitates leaving the cab, the safest means of evacuating from equipment that may be energized, the danger of the potentially energized zone around the equipment (step potential), and the need for crew in the area to avoid approaching or touching the equipment and the load.

29 CFR 1926.1412(h): Equipment not in regular use or equipment that has been idle for 3 months or more by was not inspected by a qualified person in accordance with the requirements of paragraph (e) (Monthly) of this section before initial use:    (a) Facility, 210 Rocky Acre Road, East Freedom, PA:  On or about September 8, 2015 the Pioneer truck crane that had not been used within the past 3 months was not inspected prior to being used to perform work to ensure that no deficiencies existed with the critical components.

29 CFR 1926.1427(k)(2)(i): The employer did not ensure that operators of equipment covered by this standard are competent to operate the equipment safely:    (a)    Jobsite, Armory Drive, Everett, PA:  On or about September 8, 2015 the employer did not ensure that the operator of the Pioneer 27 1/2 ton truck crane was competent to operate the equipment safely.  The operator did not know the distance required to operate equipment so that no part of the crane could contact any overhead power lines.  The operator had boomed out and was within inches of the 23kv power line.  An employee was electrocuted when they grabbed the cable line to rig a piece of steel casing and the line was pulled into the power line.
