OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to Struck by and Fall hazards relating to improperly braced trusses. -On or about September 5, 2015 employees were erecting trusses on a barn when the trusses were displaced and fell, exposing the employees to struck by and crushing hazards. The trusses were not properly braced.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: -The employer did not have an adequate safety and health training program to instruct employees in the recognition and avoidance of hazards in that: a.) Employees were working in/on wood trusses while not utilizing any type fall protection, exposed to a potential fall hazard in excess of 21'. b.) Employees were working in/on wood trusses with 80' span that had inadequate temporary bracing.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: -Employees were installing purlins on the top chords of wood trusses while not using any type of fall protection system. Potential fall height was measured to be in excess of 21'.
