29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    Borgen Masonry project site located at 940 8th St. S., Wisconsin Rapids: On and before 9/9/15, employees had not been trained to recognize and avoid or prevent unsafe conditions that could lead to serious injuries or illnesses in that:    A) Employees were not aware of the requirements for PPE or its proper use;    B) Employees were not aware of the requirement to prevent or control hazardous dusts before using PPE for personal protection.

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:  Borgen Masonry project site located at 940 8th St. S., Wisconsin Rapids: On 9/9/15, the employer did not ensure each exposed employee was using the appropriate personal protective equipment while jack hammering a concrete sidewalk, in that:  A) one employee was using ear bud head phones in place of hearing protection;  B) Both employees and the employer were wearing tennis shoes;  C) One employee was not wearing a dust mask while the employer and the other employee both had facial hair interfering with the fit of the respirators.
