29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): On or about September 2, 2015, an employee engaged in tank cleaning/rinsing operations in the formulation fill room was exposed to thermal burn hazards from water and/or steam in that the employer had not assessed the hazards associated with the task to determine the personal protective equipment (PPE) necessary to protect employees.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about September 2, 2015, an employee engaged in tank cleaning/rinsing operations in the formulation fill room at tank S-6 was exposed to amputation, struck by hazards from the agitator and thermal burn hazards from splashing hot liquid in that the latches on the tank to secure the lid were broken and not functional.
