The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. The Company had not established nor implemented an energy control program consisting of energy control procedures, training and periodic inspections.

29 CFR 1910.151(b): In the absence of an infirmary, clinic, or hospital in near proximity to the workplace which is used for the treatment of all injured employees, a person or persons shall be adequately trained to render first aid. Adequate first aid supplies shall be readily available. The employer did not ensure that an employee or employees were trained to render first aid to an injured employee in that on or about September 3, 2015 an employee received amputated fingers and emergency services did not respond to the facility until 12 minutes after the call.

Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. The employer did not report an amputation of an employee until September 8, 2015 in that on or about September 3, 2015 an employee received an amputation in a chain conveyor at the Mill Building of the company.
