29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about September 8, 2015, on the single notching machine, the employer failed to protect employees from a nip point hazard. The mechanical clamp used to hold the material in place could be activated by a single button that protruded into the operators area and would allow for unintentional activation. The single button would also allow the operator to activate the clamp while having a free hand that could access the hazardous area.

29 CFR 1910.213(m)(1): Cutting heads of wood shaper(s) were not enclosed with a cage or adjustable guard so designed so as to keep the operator's hand away from the cutting edge. On or about September 8, 2015, on the single head notching machine, the employer failed to protect employees from the rotating parts and amputation hazard when the cutting head on the machine was left guarded and would continue to spin while the operator would load materials.
