29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a)  Pack Rat Storage Solutions, LLC on or about September15, 2015, at a site located at 220 West main St Wautoma, WI:  The employer failed to ensure an accident prevention program was in place to aid the employer and his employees in the recognition and avoidance of hazards associated with commercial remolding construction operations (i.e.; fall protection, and trench protection).

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:  a)   Pack Rat Storage Solutions, LLC on or about September 15, 2015, at a site located on 220 W. Main Street, Wautoma, WI:  The employer failed to ensure that employees were provided fall protection while installing roof sheathing on a roof section of the building located on the north east side of the building being remolded. Employees were exposed to falls greater than 19 feet to the ground level.  b)  Pack Rat Storage Solutions, LLC on or about September 15, 2015, at a site located on 220 W. Main Street, Wautoma, WI:  The employer failed to ensure that employees were provided fall protection when exposed to falls greater than 13 feet to the ground while installing wood beam rafters on the  south east side of the building.

Main Street, Wautoma, WI:  The employer did not keep the excavated soil from the trench at least 2 feet from the edge of excavation to prevent soil from falling or rolling into excavation where employee(s) were hand digging the 5 foot deep excavation inside the north west end of the building.  Employees were exposed to cave-in and engulfment hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  a)  Pack Rat Storage Solutions, LLC on or about September 15, 2015, employees were hand excavating a trench that was greater than 5 feet in some locations inside the existing building so the city could later install utilities at a site located on 220 W. Main Street, Wautoma, WI:  The employer had not provided daily inspections of the trench conducted by a competent person as condition of the trench excavation changed while hand digging the trench.  The need for adequate and effective cave-in protection, method of egress, and spoil pile not kept two feet back, was not recognized and addressed while employees were working in the trench.
