Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to struck by and caught between hazards associated with operating powered industrial trucks while not utilizing the safety equipment provided: The employer is failing to protect employees from struck by hazards associated with using inadequate towing equipment to pull free a stuck semi-tractor and Sid dumper trailer. The most recent occurrence of this took place on or about September 11, 2015, at approximately 11:00 am on a job site located on Angle Road, 2 miles Southeast of Syracuse, NE where employees were instructed by their employer to pull free a stuck semi-tractor and Sid dumper trailer with a combined weight of approximately 75,000 pounds if it were an empty trailer and in this instance a full trailer increasing the combined weight to 140,310 pounds. The employees were instructed to use two 17 foot long, 5/16 inch forged 87 chains rated at 4,700 pounds each. At one end the chains were attached to the stinger or push bar located on the back of the trailer with the other end of the chains hooked to the tow hook on the back of the Caterpillar D6T Bulldozer. The sections of chain provided for employee use would have a maximum combined load rating of 9,400 pounds based upon the strongest alloys available for 1/2 inch diameter chain according to The National Association of Chain Manufacturers Welded Steel Chain Specifications. ONE METHOD OF FEASIBLE AND ACCEPTABLE METHODS OF ABATEMENT TO CORRECT THIS HAZARD INCLUDES BUT IS NOT LIMITED TO: 1. Select adequate tow cables or chains which are rated greater than or equal to that of the anticipated load. 2. Preferable method would be to purchase and use if available nylon slings that meets the weight restrictions, without metal connections in lieu of chains or cables. 3. Consider outsourcing any towing operations to a contractor which has the knowledge, equipment, and expertise to safely remove any stranded vehicle.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: The employer is failing to train employees to recognize, avoid and prevent against struck by hazards associated with using inadequate towing equipment to pull free a stuck semi-tractor and Sid dumper trailer. The most recent occurrence of this took place on or about September 11, 2015, at approximately 11:00 am on a job site located on Angle Road, 2 miles Southeast of Syracuse, NE where inadequately trained employees were instructed by their employer to pull free a stuck semi-tractor and Sid dumper trailer. Instances of inadequacy include but are not limited to: i. Failure to recognize that the chain sets chosen for the task were only rated for 4,700 pounds each. ii. Failure to recognize the obvious weight and size approximation or actual verification of tractor/trailer weight by consulting with the operator and verification by using the Department of Transportation documents; tractor trailer weighed approximately 141,000 pounds. iii. Failure to recognize the strike zone hazard associated with the potential breaking of the chains thus sending debris flying towards employees standing by.
