29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift. Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. a)Seasons Pizza Rt. 40 - On or about September 14, 2015, an employee removing materials and tools from the basket of the high lift approximately 25 to 30 feet above ground level was working without the use of a lanyard attached to the boom or basket.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) Seasons Pizza Rt. 40 - On or about September 9, 2015, the employer did not provide information and training to employees in the recognition, evaluation, and control of hazards associated with working at elevations. Employees were working from an aerial lift and near unprotected edges without the use of fall protection.
