29 CFR 1926.501(b)(4)(ii): Each employee on a walking/ working surface was not protected from tripping or stepping into or through holes by covers: a) A 2ft by 8 ft long floor hole (pipe chase) was not protected by a cover or barricade, located in the 69th street tunnel access shaft near the ladderway. Employees were exposed to floor hole hazard. Location: 2nd Ave Tunnel Project, 2nd Ave at 68th Street, New York, N.Y. On or about 7/27/2015 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.502(b)(13): When guardrail systems were used around holes which were used as access (such as ladderways), they were not provided with a gate, or were not so offset that a person could not walk directly into the hole: a) Two ladderway floor openings were not provided with a gate or offset guardrail, located on catwalks in the 69th Street tunnel access shaft. Employees are exposed to falling 18 ft to lower catwalks, and 50 ft into the shaft. Location: 2nd Ave Tunnel Project, 2nd Ave at 68th Street, New York, N.Y. On or about 7/27/2015 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
