29 CFR 1910.178(a)(4): Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: Fairgrounds midway: On or about September 14, 2015, employees were assembling an amusement ride. One employee worked from fabric wrapped forklift tines attaching the seat assembly to swing arm. This exposed the employee to the hazard of falling.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5): Fairgrounds midway: On or about September 14, 2015, employees were assembling an amusement ride using a rough terrain forklift to lift ride components and an employee. The operator had not received the required training exposing the employees to the hazards of falling, being struck by falling objectives, or struck by the forklift.
