29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident:     A)    WIT Logistics, LLC, located at 315 Matzinger Road, Toledo, OH 43612: On or about September 3, 2015, the employer failed to provide refresher training in safe operation of a powered industrial vehicle for the employee who was involved in an incident/near miss while driving the Clark stand-up forklift (Model ESX15S, Serial # ESX250 0117 9706FL) in the facility. The operator bumped a cart with parts while another employee was standing on the other side of the cart. Employees were exposed to struck-by hazards due to the lack of re-training.
