OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) At the GDOT Jimmy DeLoach connector jobsite in Port Wentworth, GA: On September 17, 2015 and times prior thereto, the employer exposed its employees to hazards not limited to amputations, in that the motor of a Barbco boring machine remained running prior to removing a BBC-25 cutting head from an auger shaft.

29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions: a) At the GDOT Jimmy DeLoach connector jobsite in Port Wentworth, GA: On September 17, 2015 and times prior thereto, the employer exposed its employees to hazards not limited to ejection-from and struck-by, and potential death, in that seatbelts were not always fastened on Komatsu track-hoes while engaged in earthmoving and related activities.
