29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): A) Sunland Logistics Solutions, Inc., located at 4080 Bennett Road, Toledo, OH 43612: On or about August 10, 2015, the employer failed to provide training and evaluation to ensure that employees, operating powered industrial vehicles such as, but not limited to, the Toyota forklift (Model 7FBEU15, Serial # 27057) and the Toyota forklift (Model 7FBEU18, Serial # 17515), were competent to safely complete the task. Employees were exposed to struck-by, caught-in-between, and tip-over hazards.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident: A) Sunland Logistics Solutions, Inc., located at 4080 Bennett Road, Toledo, OH 43612: On or about August 10, 2015, the employer failed to provide refresher training in safe operation of a powered industrial vehicle for the employee who was involved in an incident/near miss while driving the Toyota forklift (Model 7FBEU18, Serial # 17515) in the facility. The operator dropped a skid with automotive rims on the ground. Employees were exposed to struck-by hazards due to the lack of refresher training.

Employees were exposed to struck-by and caught-in-between hazards.
