Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazard of being struck by a tree which are causing or likely to cause death or serious physical harm to employees: On or about June 1, 2015, at a residential home where an employee handling a tagline was exposed to a struck-by hazard when standing within the strike zone as a tree was cut at the base.
