29 CFR 1910.23(a)(9): Every floor hole into which persons cannot accidentally walk (on account of fixed machinery, equipment, or walls) were not protected by a cover that leaves no openings more than one inch wide. On or about September 18, 2015, at the above addressed jobsite, employees working near the welder in the northeast corner of the second floor of the structure, were exposed to a rusted floor plate measuring approximately 2 to 3 inches had developed on the walking surface was not protected with a securely held floor hole cover to prevent anyone from accidentally stepping into the hole.

29 CFR 1910.146(d)(9): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces: On or about September 18, 2015, the employer did not develop effective confined space rescue procedures for the horizontal and vertical confined space configurations at the facility. The procedure of response from the local Fire Department entails a response time of approximately 14 minutes for the initial responders. The initial responders then call Special Operations of the same department located an additional 34 minutes. The estimated total response time for a confined space rescue for the facility was estimated to be 48 minutes.
