OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling and soft tissue injury while operating a dock leveler with a damaged frame: Employees were exposed to soft tissue injury and falls by having to forcefully push the sides of the dock leveler by foot to create frame alignment and then run upon to the dock leveler ending the run with jumping force to force it to come to the complete and correct down position.
