29 CFR 1910.132(a): The employer did not ensure the affected employees were provided with, used, and maintained in sanitary and reliable condition, personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:      a) On or about 9/19/15, on jobsite at 2775 Hopkins Rd., Amherst, NY:  Employees were working on a jobsite that involved the removal of a large tree. The employees were using a chain saw to cut branches from the tree, and  to cut the limbs that had fallen to the ground into smaller pieces. The employeer did not provide the affected employees with personal protective equipment for the eyes and face, head or extremities (pants or chaps that contain pads of cut retardant material). Employees were exposed to eye and face injuries from flying wood splinters and lacerations /amputation.      NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) On or about 9/19/15, on jobsite at 2775 Hopkins Rd., Amherst, NY:  Employees were working on a jobsite that involved the removal of a large tree.  An employee climbed the tree and was using a chainsaw to cut limbs off the tree from inside the tree.  The employee was exposed to being struck in the eyes and face by wood particles being propelled from the chainsaw.  Additionally, the employee could potentially be struck in the eye and face by the kickback of the chainsaw.  The employer did not provide the employee with eye and face protection.  b) On or about 9/19/15, on jobsite at 2775 Hopkins Rd., Amherst, NY:  Employees were working on a jobsite that involved the removal of a large tree.  Employee using a chainsaw to cut up limbs that had fallen to the ground after being cut by the employee in the tree was exposed to being struck in the eyes and face by wood particles being propelled from the chainsaw.  Additionally, the employee could potentially be struck in the eye and face by the kickback of the chainsaw, and by the springback of branches under tension in the delimbing process.  The employer did not provide the employee with eye and face protection.   NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:   a) On or about 9/19/15, on jobsite at 2775 Hopkins Rd., Amherst, NY:  Employees were working on a jobsite that involved the removal of a large tree.  An employee climbed the tree and was using a chainsaw to cut limbs off the tree from inside the tree.  The employee was exposed to being struck by branches that might be broken, stuck in the canopy and jarred loose and fall, or by limbs/branches that are rotted out and could fall at any time.  Additionally, the employee could potentially be struck in the head by the kickback of the chainsaw.  The employer did not provide the employee a hardhat.  b) On or about 9/19/15, on jobsite at 2775 Hopkins Rd., Amherst, NY:  Employees were working on a jobsite that involved the removal of a large tree.  Employee using a chainsaw to cut up limbs that had fallen to the ground after being cut by the employee in the tree was exposed to being struck by branches that might be broken, stuck in the canopy and jarred loose and fall, or by limbs/branches that are rotted out and could fall at any time.  Additionally, this employee could potentially be struck in the head by the kickback of the chainsaw, and by the springback of branches under tension in the delimbing process. Employees involved in stacking of the cut wood and dragging branches to the curb enter the area near the tree and were exposed to being struck by branches that might be broken, stuck in the canopy and jarred loose and fall, or by limbs/branches that are rotted out and could fall at any time.  The employer did not provide the employee a hardhat.   NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):      a) On or about 9/19/15, on jobsite at 2775 Hopkins Rd., Amherst, NY:  Employees were working on a jobsite that involved the removal of a large tree. One employee climbed the tree and was using a chainsaw to cut limbs off the tree from inside the tree. Other employees used chainsaws to cut up limbs that had fallen to the ground after being cut by the employee in the tree. The rest of the employees were involved in stacking of the cut wood and dragging branches to the curb. The employer did not perform a Hazard Assessment of the jobsite to determine if hazards were present, or were likely to be present, which necessitate the use of personal protective equipment (PPE).     NO ABATEMENT CERTIFICATION REQUIRED
