29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:    a. On or about August 25, 2015, at the above located jobsite, employees performing masonry operations were exposed to the hazards associated with chemicals such as silica and Portland cement. The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in paragraph (h) will be met.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.  a. On or about August 25, 2015, at the above located jobsite, employees performing masonry operations were exposed to the hazards associated with chemicals such as, silica and Portland cement. The employer did not provide training on the hazards associated with silica and Portland cement.

On or about August 25, 2015, at the above addressed jobsite, employees conducting masonry operations from a tubular welded scaffold approximately thirteen (13) feet six (6) inches above the lower surface that was not fully planked, thereby exposing employees to fall hazards.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold:    a. On or about August 25, 2015, at the above addressed jobsite, employees conducting masonry operations from a tubular welded scaffold approximately thirteen (13) feet six (6) inches above the lower surface were not protected from falls, thereby exposing employees to hazards associated with falls. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.451(G)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 987928, CITATION NUMBER 1, ITEM NUMBER 2 AND WAS AFFIRMED AS A FINAL ORDER ON OCTOBER 22, 2014, WITH RESPECT TO A WORKPLACE LOCATED AT 1611 N. HERMITAGE AVE., CHICAGO, IL.
