OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about 09/18/15, at the job site located at 4974 Heege Road, Afton MO., employee(s) were exposed to struck-by hazards while operating a Prime Equipment mixer (Model: 1258PM, S/N: 3299242). The employer provided a cheater bar that fit over (not secured) drum dump arm thereby modifying the mixer to provide added leverage when dumping the rubber polymer compound mixture. One method of abatement is for the employer to discontinue the use of the cheater bar.

Within eight (8) hours after the death of any employee as a result of a work-related incident, you must report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor: On or about 09/18/2015, an employee working for S. Bollinger & Associates, LLC located at 5462 Hillsboro Hematite Road, De Soto, MO, received a work related struck-by incident which resulted in the employee passing on 09/19/2015. The employer failed to contact OSHA within the required 8 hour period.
