Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to equipment roll over. On September 23, 2015, at 1812 Carrington Way, in Swansea, Illinois, an employee was exposed to equipment roll over hazards when operating a SCAG Turf Tiger (model STT61V-791, serial number H9600165) zero turn commercial mower near pond drop offs. The employee was not using a seat belt while the roll over protection structure (ROPS) was in use.
