29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift: a) Jobsite: On September 24, 2015 the controlling employer, Engineered Structures, Inc., did not ensure that its sub-contractor protected their employees. The sub-contractor did not have a competent person to conduct an inspection prior to the start of their work and as needed throughout the trenching and employee work activities in the trench. Note) The competent person definition applicable to this subpart means one who is capable of identifying existing and predictable hazards in the surroundings, or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. Note) Abatement certification AND documentation are required for this item.
