29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) On or about 09/23/2015 - Fabrication area, an employee conducting welding and fabricating work was exposed to occupational noise at 200.1% of the allowable 8-hour time-weighted average of 85 dBA or an equivalent sound level of 95.0 dBA. The sampling was performed for 435 minutes on 09/22/2015. Zero exposure was assumed for the remainder of the shift. (b) On or about 09/22/2015 - Fabrication area, an employee conducting welding and fabricating work was exposed to occupational noise at 85.9% of the allowable 8-hour time-weighted average of 85 dBA or an equivalent sound level of 89.9 dBA. The sampling was performed for 430 minutes on 09/23/2015. Zero exposure was assumed for the remainder of the shift. (c) On or about 09/22/2015 - Fabrication area, an employee conducting welding and fabricating work was exposed to occupational noise at 92.7% of the allowable 8-hour time-weighted average of 85 dBA or an equivalent sound level of 89.4 dBA. The sampling was performed for 426 minutes on 09/23/2015. Zero exposure was assumed for the remainder of the shift.
