29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:  Painting Department: On or about September 29, 2015, employee(s) who perform spray paint processes were exposed to chemical hazards from the use of paints, activators, hardeners and additives containing chemicals such as, but not limited to, 1,6 hexamethylene diisocyanate and aliphatic polyisocyanate resin, which are skin sensitizers, as well as various organic chemicals and solvents, without chemically resistant personal protective equipment, including chemically resistant work boots or boot covers.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a) Paint Department: On or about September 29, 2015, employee(s) were exposed to hazards of undue physiological burden from the required use of SATA Supplied Air Respirators while performing spray paint processes in an enclosed spray paint booth and the employer did not establish a written respiratory protection program or implement provisions of the program, such as but not limited to medical evaluations, fit tests, or selection and maintenance of respirators.  (b) Paint Department: On or about September 29, 2015, employee(s) were exposed to hazards of undue physiological burden from the voluntary use of 3M tight-fitting half mask respirators without first receiving a medical evaluation to determine that the employees were medically able to use that respirator.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  At Facility: On or about September 29, 2015, and times prior there to, the employer did not implement or maintain an effective written Hazard Communication Program to train and inform employee(s) who handle, use, transport or are potentially exposed to hazards from chemicals, such as but not limited to, 1,6 hexamethylene diisocyanate, Aliphatic polyisocyanate resin, Toluene, Acetic acid, Ethyl benzene, and Methyl ethyl ketone from paints, hardeners, activators, additives, lacquer thinners and cleaning solvents.
