Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by vehicles due to poor illumination:  a) Argix Direct, Inc. dba Argix Logistics 100 Middlesex Center Blvd, Jamesburg, NJ site - Truck Yard:  On or about  September 30, 2015, and times prior thereto, the employer  did not ensure that adequate illumination was being maintained for switcher employees performing switcher truck operations around the truck yard throughout the day to including the dark hours of the morning and night, exposing employees to being struck-by the moving trucks due to inadequate illumination.

29 CFR 1910.132(a): The employer did not ensure protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    a) Argix Direct, Inc. dba Argix Logistics 100 Middlesex Center Blvd, Jamesburg, NJ site - Truck Yard:  Employees were not provided high visibility vests when exposed to vehicle traffic while making rounds and switching the trailers in the yard, accessing their switcher vehicles during the dark hours of the morning and night.      Observed on/or about 09/30/2015.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):   a)Argix Direct, Inc. dba Argix Logistics 100 Middlesex Center Blvd, Jamesburg, NJ site - Truck Yard:  Employer failed to develop a hazard assessment for yard switcher personnel. Hazardous conditions and Personal Protective Equipment (PPE) such as but not limited to employee visibility were not addressed.     Employees are required to walk across the terminal's truck yard to perform daily yard tasks, and access their yard switcher vehicles during the dark hours of the morning and night.   Condition noted on/or about 9/30/15.
