29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).    On or about October 1, 2015, at the above addressed job site, the employer did not ensure that frequent and regular inspections of the job sites, and equipment were made by competent persons designated by the employer to ensure employees had been following appropriate Lock Out procedures before entering the concrete hopper to use a chipping gun to remove hardened concrete.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    On or about October 1, 2015, at the above addressed job site, the employer failed to properly train an employee on specific Lock Out procedures to control or eliminate crushing and amputation hazards regarding the safe operation and cleaning of the concrete pump truck hopper, before entering the hopper to use a chipping gun to remove hardened concrete and the auger inadvertently started.

29 CFR 1926.702(j)(1): Employee(s) was/were permitted to perform maintenance or repair work on equipment (such as compressors, mixers, screens or pumps used for concrete and masonry construction activities), where the inadvertent operation of the equipment could occur and cause injury, unless all potentially hazardous energy sources have been locked out and tagged.  On or about October 1, 2015, at the above addressed job site, the employer permitted an employee to enter a concrete pump truck hopper to perform cleaning with a pneumatic chipping gun, where the hydraulic pressure had not been secured and locked out, which caused the auger to inadvertently start.
