OSH ACT of 1970 Section (5)(a)(1):      The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to a fall hazard associated with failing to following guidelines for weigh capacities and maintenance of an elevator/manlift at the facility.         i.  On October 2, 2015, two employees entered the elevator/manlift and it failed causing the car to fall from the top of the structure (over 50 feet).  The combined weight of the employees was approximately 460 to 500 pounds.  The capacity of the elevator/manlift was listed at 300 pound which shows that the capacity was exceeded by at least 160 pounds or approximately 153%.       ii.  The company has failed to periodically clean the cables for the elevator/manlift allowing dust to accumulate on the cables which can allow slippage.           Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citations.

29 CFR 1910.1200(h)(3)(iii):  This provision is applicable to Agricultural employment by 1928.21.    Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used:    Work site located at 49705 832nd Road, Bartlett, NE  68622:  The employer failed to provide training as prescribed in the paragraph above in that the employees had not been trained on the hazards of the chemicals that they commonly use including but not limited to L-Lysine Monohydrochloride, Acetylene (dissolved), and various lubricants.         Abatement certification is required for this violation.  The abatement certification sheet is enclosed with the citations.
