29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) (a) Warehouse - The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely by successful completion of training and evaluation on each different type of powered industrial truck available for employee use such as but no limited to powered pallet jacks, sit-down forklifts, order pickers, reach trucks. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l): (a) Warehouse - The employer did not certify that each forklift truck operator had been evaluated as required by paragraph (l), with certification records that includes the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the evaluation.
