Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing injuries and struck by hazards from a falling load while using overhead electric powered hoists: a. On or about October 6, 2015, at the assembly area, the lifting device had not been inspected periodically or proof tested and certified by the employer to ensure that critical components of the overhead electric powered hoist, including but not limited to the hoist motor, chains and components did not malfunction while in operation.
