29 CFR 1926.501(c)(1): When employees were exposed to falling objects, the employer did not have each employee wear a hard hat and did not erect toeboards, screens, canopy structures or barricades to prevent objects from falling from higher levels: On or about October 2, 2015, west side of the 4th floor, a toeboard was not present at an interior wall opening that was overhead of the west stairs. Employees in the west stair well were exposed to being struck-by falling objects from the 4th floor wall opening.

29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level:Note: When employees are using stilts, the top edge height of the top rail, or equivalent member, shall be increased an amount equal to the height of the stilts. On or about October 2, 2015, west side of the 4th floor, an interior wall opening was not guarded with a top rail that was 42 inches above the walking surface which exposes employees to falls greater than 6 feet to a lower level.
