29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure and employee training to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated, and rendered inoperative in accordance with 29 CFR 1910.147(c)(4):     a)    In the chemical plant and throughout the facility: On October 7, 2015, and at times prior thereto, the employer exposed its employees to hazards not limited to crush-by, in that an energy-control program was not established containing specific procedures, employee training, and periodic inspections, before allowing employees to perform servicing and maintenance of equipment and machinery.

29 CFR 1910.147(c)(4)(ii): The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including, but not limited to Items of this section:   a)    In the chemical plant 231 at the conversion vessel on Line #1: On October 7, 2015, and at times prior thereto, the employer exposed its employees to hazards not limited to crush-by, in that energy-control procedures failed to clearly and specifically outline steps to be followed for the placement of lockout or tagout devices, and failed to ensure that control measures were utilized prior to troubleshooting a malfunctioning lid.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees:  a)    In the chemical plant 231 and throughout the manufacturing facility: On October 7, 2015, and at times prior thereto, the employer exposed its employees to hazards not limited to crush-by, in that adequate communication and training was not provided regarding the safe application and usage of locks and tags prior to allowing employees to perform maintenance of equipment and machinery.
