OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to asphyxiation hazards: a. On or about October 7, 2015, in the line B boxing room, employees were exposed to hazards of an asphyxiant gas when manually adding nitrogen gas to "supersacks" or flexible containers, prior to adding finished products.

29 CFR 1910.23(c)(3): Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards shall be guarded with a standard railing and toe board. a. On or about October 7, 2015, on Line A Drum Dryer #4, employees were exposed to hazards associated with heat and moving equipment when the platform next to the drum dryer was not equipped with a standard railing and toe board.

29 CFR 1910.24(h): "Railings and handrails." Standard railings shall be provided on the open sides of all exposed stairways and stair platforms. Handrails shall be provided on at least one side of closed stairways preferably on the right side descending. Stair railings and handrails shall be installed in accordance with the provisions of 1910.23. a. On or about October 7, 2015, at Line A drum dryer #4, employees were required to access the platform with the use of a fixed stairway. Employees were exposed to slip, trip and fall hazards when the stairway was not equipped with a standard handrail on each side of the non-enclosed stairway.
