29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At East Chase Apartments Bldg. 6 West Side Montgomery, Alabama:  On or about October 7, 2015 and at times prior; the employer allowed his employees to walk the tops of the framed walls on the third level of the apartment building without fall protection in order to secure the wall exposing the employee to a fall hazard of 30 feet 4 1/2 inches to the ground below.  b)  At East Chase Apartments Bldg. 6 North Side Montgomery, Alabama:  On or about October 7, 2015 and at times prior; the employer allowed his employees to work next to the edge where there was no guardrails  and a broken guardrail without fall protection exposing the employee to a fall hazard of 21 feet 3 1/2 inches to the ground below.  c)  At East Chase Apartments Bldg. 6 North Side Montgomery, Alabama:  On or about October 7, 2015 and at times prior; the employer allowed his employees to walk up to the edge of the building to dispose of building debris without fall protection exposing the employee to a fall hazard of 21 feet 3 1/2 inches to the ground below.  d)  At East Chase Apartments Bldg. 6 South Side Montgomery, Alabama:  On or about October 7, 2015 and at times prior; the employer allowed his employees to stand next to the edge of the building while securing a wall to the floor without fall protection exposing the employee to a fall hazard of 21 feet 3 1/2 inches to the ground below.  e) At East Chase Apartments Bldg. 6 South Side Montgomery, Alabama:  On or about October 7, 2015 and at times prior; the employer allowed his employees to use a job made ladder to gain access to and from the second level of the building and the platform they stood on to get on and off the ladder did not have guardrails exposing the employees to a fall hazard of 10.7 feet to the ground below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a)  At East Chase Apartments Bldg. 6 South Side Montgomery, Alabama:  On or about October 7, 2015 and at times prior; the employer allowed his employees use a job made ladder to gain access to and from the upper levels of the apartment building and the rails of the ladder did not extend at least three feet above the landing area exposing employees to a fall hazard of 10.7 feet to the ground below.
