29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions:  Along the exterior east side of the residential construction building, on or about October 07, 2015, employees were exposed to chemical exposures to the skin while working with wet Portland cement that can cause caustic burns without having adequate personal protective equipment such as, but not limited to, gloves, aprons and/or protective suits.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (Construction Reference 1926.103)  Along the south east section of the residential construction building, on or about October 07, 2015, employees performing wet cement mixing procedures with USG Levelrock 2500 cement were exposed to a hazard of undue physiological burden from the use of respirator masks, such as but not limited to a 3M half mask with cartridges and a N95 type dust mask, without first receiving a medical evaluation to determine that the employees were medically able to use that respirator.
