29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: a) Work site - On or about October 13, 2015 and at times prior thereto, 2 employees were repairing a telecommunication line in a trench that was 7' in depth with no protective system in place. Neither of the employees could have appropriately inspected the trench as they did not have enough training or knowledge to be considered competent in trenching.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): a) Work site - On or about October 13, 2015 and at times prior thereto, 2 employees were repairing a telecommunication line in a trench with vertical walls and having no protective system in place. At the location of work the trench measured 7' in depth, 6' wide, and it was approximately 20' in length.
