OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, on October 9, 2015, a maintenance employee was exposed to struck-by and caught-in hazards while guiding/holding the gondola/ride capsule of the SlingShot ride prior to a maintenance launch, as he had been trained to do by the ride manufacturer. A feasible and acceptable method to abate this hazard would be the following: Employees are no longer to be inside the controlled area while the gondola is being raised in maintenance mode.

29 CFR 1910.147(d)(2): An orderly shutdown of machine or equipment was not utilized to avoid any additional or increased hazards to employees as a result of equipment stoppage: a) Cedar Fair LP on or about October 09, 2015, at the address of 1 Cedar Point Dr. Sandusky, OH: The employer failed to ensure that energy isolating procedures for shutdown were performed prior to conducting maintenance work on the Slingshot ride. Employees performing these tasks in energized condition were exposed to struck-by and caught-on hazards while operating inside the controlled area at the ride's launch point, in that energy control shutdown procedures required under 29 CRF 1910.147(d) were not utilized before the employee began the aforementioned maintenance task on the machine.

29 CFR 1910.147(c)(7)(i): The employer did not provide adequate training to ensure that the purpose and function of the energy control program was understood by employees: a) Cedar Fair LP on or about October 09, 2015, at the address of 1 Cedar Point Dr. Sandusky, OH: The employer failed to ensure that employees who are exposed to moving parts during service and maintenance work on the Slingshot ride were adequately trained in the skills required for the safe application, usage and methods to isolate and control potential hazardous energy sources. The employees tasked with service work on the aforementioned ride were not specifically trained to lockout the ride prior to entering the controlled launch area. Employees operating in this condition were exposed to caught-on and/or struck-by hazards.
