29 CFR 1910.272(d): The employer did not develop and implement an emergency action plan meeting the requirements contained in 1910.38(a):  Employees engaged in grain storage bin entry operations were exposed to hazards including engulfment in flowable grain and the employer did not implement an effective emergency action plan that included at a minimum:   1. Procedures for reporting a fire or other emergency. 2. Procedures for emergency evacuation, including type of evacuation and exit route assignments. 3. Procedures to be followed by employees who remain to operate critical plant operations before they evacuate. 4. Procedures to account for all employees after evacuation. 5. Procedures to be followed by employees performing rescue or medical duties. 6. The name or job title of every employee who may be contacted by employees who need more information about the plan or an explanation of their duties under the plan.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.272(e)(1): The employer did not provide training to employees at least annually and when changes in job assignments would expose them to new hazards in the grain handling facilities:  The company failed to provide training to employees on an annual basis to recognize hazards within the facility.  Employees were regularly exposed to engulfment hazards during grain bin entries and crushing hazards during equipment servicing operations.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.272(g)(2): When entering the grain handling facility bins, silos, or tanks from the top, employees did not wear a body harness with lifeline, or use a boatswain's chair that met the requirements of Subpart D, 29 CFR 1910.28(j).  On or about October 7, 2015 employees entered storage "Bin 42" from the top bin hatch to shovel soybeans out of the bin while it was approximately halfway full of corn. Employees were exposed to being trapped/engulfed and were not required to wear a body harness with a lifeline, or use a boatswain's chair to facilitate removal or rescue in case of engulfment in soybeans.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.272(g)(3): An observer, equipped to provide assistance, shall be stationed outside the bin, silo, or tank being entered by an employee. Communications (visual, voice, or signal line) shall be maintained between the observer and employee entering the bin, silo, or tank.  On or about October 7, 2015 employees entered grain bin 42 where an engulfment hazard was present from flowable corn and soybean stored in the bin. An observer was not stationed outside of the bin to provide assistance and communicate in case of an emergency where rescue would be required.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.272(j)(1): The employer did not develop and implement a written housekeeping program that established the frequency and the method(s) determined best to reduce accumulations of fugitive grain dust on ledges, floors, equipment, and other exposed surfaces.  The employer did not develop a written housekeeping program.  Dust accumulations that were likely to be combustible were observed near the dump pit.
