29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1) Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) On or about 10/13/15 on a jobsite located at 540 Sunset Dr., Hamburg, NY: An Excavator was at the east end of a trench and a ladder was placed in the excavation at the west end. The total length of the excavation was 22 ft. 9in. The east end of the excavation was a narrow trench that was approx. 14 ft. long x 2 ft. 6 in. wide x 4 ft. 7 in. deep to 5 ft. 1 in. deep. The west end of the excavation was approx. 8 ft. long x 5 ft. 8 in. wide x 5 ft. 7 in. deep. An employee climbed down the ladder at the west end of the trench and walked to the east end of the trench to hold down a 2 inch copper water line being installed. The sides of the excavation were vertical and no cave-in protection was provided. NO ABATEMENT CERTIFICATION REQUIRED

Protection by placing and keeping such materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary was not provided. a) On or about 10/13/15 on jobsite located at 540 Sunset Dr., Hamburg, NY: The spoil pile was less than 2 ft. away from the excavation edge on the north bank of the wide end of the excavation (west end), varying from approx. 7 to 15 inches. NO ABATEMENT CERTIFICATION REQUIRED
