OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:    a)  451 Brownsburg Road West, Upper Makefield Township, Worksite - On or about October 15, 2015, the Bobcat Model T300 Skidsteer was operated in reverse without a functioning backup alarm as a warning device for employees located in the vehicle's path of travel.      Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to ensure the full operability of vehicles and mobile equipment as outlined in ANSI Z133 - 2012, Section 5.1.2, which states, "Units shall be equipped and maintained with manufacturer's safety devices, instructions, decals, and safeguards".

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    a)  451 Brownsburg Road West, Upper Makefield Township, Worksite - on or about October 15, 2015, the employer did not provide cut resistant leg protection for employees who operate chain saws while performing tree trimming work.    Note: One feasible and acceptable abatement method, among others, to correct this hazard is to provide safety chaps or trousers for employee use as required by ANSI Z133.1, Tree Care Operations Pruning, Trimming, Repairing, and Removing Trees, and Cutting Brush Safety Requirements, Section 4.2.7: Chain saw resistant leg protection shall be worn while operating a chain saw during ground operation.
