29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:  a) Shop - On or about 10/13/15 and at times prior thereto employees working in furniture refinishing applied paint strippers, wood stains, coatings and diluents. The employer did not establish the  identity and concentration of the chemicals in the air, and did not assess the corresponding exposures of workers to such chemicals.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) Shop - On or about 10/13/15 and at times prior thereto employees working in furniture refinishing applied paint strippers, wood stains, coatings and diluents. The employer provided and instructed the use of half face negative pressure cartridge respirators, and did not establish and implement a written Respiratory Protection Program.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

The employer provided and instructed the use of half face negative pressure cartridge respirators, and did provide in advance a medical evaluation to determine the employee's ability to wear a respirator.
