Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards from non stabilized sling lifts: (a) On or about September 30, 2015 for the employee that was crushed by an inadequately secured industrial box fan that fell while being lifted by a JLG All Terrain Forklift using round slings in a basket configuration at the Roosevelt Cryogenic Plant on 12527 Spring Creek Road Watford City, ND. NOTE: One feasible and acceptable means of abatement would be to follow the 2005 Safety Standards for Rough Terrain Forklift Trucks under section 6-Operating Safety Rules and Practices it states in 6.4.3 Handle only stable and safely arranged loads and in 6.4.4 When attachments are used, extra care shall be taken securing, manipulating, positioning, and transporting the load.
