29 CFR 1926.502(f)(1)(i): When no mechanical equipment was being used the warning line was not erected at least 6 feet (1.8m) from the roof edge: a) On the Low-Sloped Commercial Roof - On or about October 14, 2015, employees, installing roofing material on a low-sloped commercial roof, were not adequately protected by the combination of warning line system and safety monitoring system that was in use because the warning line was not maintained more than 6 feet from the east edge of the roof, exposing employees to a 20 or 21.4-foot fall hazard onto a parked equipment truck and trailer. The warning line was observed to be between 24 inches and 32 inches [1.5 and 2 16-inch concrete blocks] from the east 32-inch [4 8-inch concrete blocks] high parapet wall. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.502(h)(1)(v): The safety monitor had other responsibilities which could take the monitor's attention from the monitoring function: a) On the Low-Sloped Commercial Roof - On or about October 14, 2015, employees, installing roofing material on a low-sloped commercial roof, were not adequately protected by the combination of warning line system and safety monitoring system that was in use because the safety monitor was bent over working and exposed to the fall hazard by being outside the warning line system on the north edge of the roof, exposing employees to a 20 or 21.4-foot fall hazard onto a parked S-240 Somero Laser Screed as the safety monitor's attention was diverted from monitoring by his assigned work responsibilities. No abatement certification or documentation required.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii): a) On the Low-Sloped Commercial Roof - On or about October 14, 2015, employees, installing roofing material on a low-sloped commercial roof, were not adequately protected by the combination of warning line system and safety monitoring system that was in use because the employer had not assured that the employees were effectively trained on the use and operation of a combination of warning line system and safety monitoring system or the role of each employee in the safety monitoring system, including the Safety Monitor's role of consistent visual observing of monitored employees, to maintain the ability to easily communicate with monitored employees, and to not be involved in other activities or responsibilities which would divert attention from the Safety Monitoring role. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
