29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l): On or about October 16, 2015, the employer failed to certify that a PIV operator was retrained after he was observed operating a PIV in an unsafe manner when he transported an injured employee to the other side of the facility via a pallet that was loaded on the PIV forks (Crown Hi Reach PIV Serial #1A412116). This certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.
