OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to standing on a weight-bearing roof where, during the course  of the work, a skylight panel could fail if subjected to the weight of a worker.  The employer failed to identify or to take into account that near identical non-weight bearing sections which were built flush into the roof surface would not support he weight of a worker.  The employer did not properly assess the potential risks of working from the surface of the warehouse roof in that it did not properly identify panels on the roof that could not support the weight of a worker, either due to their age, condition or intrinsic design.    (a) On or about October 8, 2015, at the Main Warehouse, East side roof at 454 River Road, Glenmont, N.Y., because the employer did not provide properly engineered equipment prior to requiring employees to work from the roof which exposed employees to falling through roof panels made of translucent material.  The employer failed to recognize that the translucent sections from the outside of the building as being different non-weight bearing roof sections and failed to consider that the skylight panels might not support the weight of a worker.  As a result the employer did not implement engineering controls or precautions to deal with the Employees exposure.
