29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):     On or about October 16, 2015, at a worksite located at 142 Arlington Ave NW, Canton, OH 44708, during commercial low slope roofing activities the employer did not ensure the operator of the rough terrain forklift, JLG/Gradall G9-43A was competent and allowed the operator to leave the load engaging means raised while the rough terrain forklift was unattended.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:     a. On or about October 16, 2015, at a worksite located at 142 Arlington Ave NW, Canton, OH 44708, during commercial low slope roofing activities the employer did not ensure employees working on the lower roof, west section were protected from fall hazards, approximately 22.7 feet, by ensuring a guardrail system, safety net system, personal fall arrest system, or a safety monitoring system was being used.       b. On or about October 16, 2015, at a worksite located at 142 Arlington Ave NW, Canton, OH 44708, during commercial low slope roofing activities the employer did not ensure an employee working on the upper roof, east section was protected from fall hazards, measured over 25 feet, by ensuring a guardrail system, safety net system, personal fall arrest system, or a safety monitoring system was being used.

29 CFR 1926.502(f)(1): Warning lines were not erected around all sides of the roof work area:   On or about October 16, 2015, at a worksite located at 142 Arlington Ave NW, Canton, OH 44708, during commercial low slope roofing activities the employer did not ensure employees working on the lower roof, west section were protected from fall hazards, approximately 22.7 feet, by ensuring a guardrail system, safety net system, personal fall arrest system, or a safety monitoring system was being used. The area did not have any warning line system installed and no form of fall protection utilized.

29 CFR 1926.502(f)(2)(ii): The rope, wire, or chain was not rigged or supported in such a way that its lowest point (including sag) was not less than 34 inches (0.9 m) from the walking/working surface and its highest point no more than 39 inches (1.0 m) from the walking/working surface.   On or about October 16, 2015, at a worksite located at 142 Arlington Ave NW, Canton, OH 44708, during commercial low slope roofing activities the employer did not ensure all warning lines were properly rigged to ensure the lowest point was not less than 34 inches from the walking working surface. The warning line was below 34 inches on the eastern section of the upper roof, the southeastern section of the lower roof near the ladder and in other areas around the roof.
