29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    On or about October 22, 2015, the employer had not administered a hearing conservation program for employees exposed to noise that exceeded an 8-hour time-weighted average (TWA) of 85 dBA, based on an 80 dB threshold:    (a) In the floor production area, a lead worker was exposed to noise levels at 103.4% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 103.4% is approximately 90.2 dBA.  Sampling was performed for 470 minutes during one shift.  Zero exposure was assumed for the unsampled period of 10 minutes.    (b) In the floor production area, a worker was exposed to noise levels at 191.8% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 191.8% is approximately 94.7 dBA.  Sampling was performed for 460 minutes during one shift.  Zero exposure was assumed for the unsampled period of 20 minutes.    (c) In the floor production area, a worker was exposed to noise levels at 112.9% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 112.9% is approximately 90.8 dBA.  Sampling was performed for 468 minutes during one shift.  Zero exposure was assumed for the unsampled period of 12 minutes.    (d) In the floor production area, a worker was exposed to noise levels at 97.78% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 97.78% is approximately 89.8 dBA.  Sampling was performed for 465 minutes during one shift.  Zero exposure was assumed for the unsampled period of 15 minutes.    (e) In the roof production area, a worker was exposed to noise levels at 164.3% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 164.3% is approximately 93.5 dBA.  Sampling was performed for 465 minutes during one shift.  Zero exposure was assumed for the unsampled period of 15 minutes.    (f) In the roof production area, a worker was exposed to noise levels at 138.0% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 138.0% is approximately 92.3 dBA.  Sampling was performed for 469 minutes during one shift.  Zero exposure was assumed for the unsampled period of 11 minutes.    (g) In the roof production area, a worker was exposed to noise levels at 72.01% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 72.01% is approximately 87.6 dBA.  Sampling was performed for 469 minutes during one shift.  Zero exposure was assumed for the unsampled period of 11 minutes.    (h) In the production shop, a support worker was exposed to noise levels at 97.04% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 97.04% is approximately 89.7 dBA.  Sampling was performed for 472 minutes during one shift.  Zero exposure was assumed for the unsampled period of 8 minutes.

29 CFR 1910.95(i)(2)(i): The employer did not ensure that hearing protectors are worn by an employee who is required by 29 CFR 1910.95(b)(1) to wear personal protective equipment:    On or about October 22, 2015, the employer did not ensure that hearing protectors were worn by employees who were exposed to noise that exceeded an 8-hour time-weighted average (TWA) of 90 dBA, based on a 90 dB threshold:    (a) In the floor production area, a worker was exposed to noise levels at 174.0% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 174.0% is approximately 94.0 dBA.  Sampling was performed for 460 minutes during one shift.  Zero exposure was assumed for the unsampled period of 20 minutes.    (a) In the roof production area, a worker was exposed to noise levels at 139.0% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 139.0% is approximately 92.3 dBA.  Sampling was performed for 465 minutes during one shift.  Zero exposure was assumed for the unsampled period of 15 minutes.
