29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:  (a)     At 935 Montlimar Drive (Behind the building/East side): On October 20, 2015, and at times prior, the employer exposed employees to worksite hazards in that the employer failed to instruct his employees in the recognition and avoidance of unsafe conditions and the regulations applicable to their work environment to control or eliminate any hazard(s) or other exposure to illness or injuries.  Employees were not trained to  inspect for underground utilities and only received generalized training on trench safety.

29 CFR 1926.651(b)(1): The estimated location of underground utility installations, such as sewer, telephone, fuel, electric, water lines, or any other underground installations that reasonably may be expected to be encountered during excavation work, were not determined prior to opening an excavation.  (a)     At 935 Montlimar Drive (Behind the building/East side): On October 20, 2015, and at times prior, the employer failed to located underground utilities prior to digging exposing employees to electrical hazards, in that energized electrical wires in PVC conduit was dug up during excavation of a trench and employees were working near it without it being de-energized.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  (a)     At 935 Montlimar Drive (Behind the building/East side): On October 20, 2015, and at times prior, the employer exposed employees to cave in hazards in that an inspection of a trench or an excavation 17' 5" in length, 10' 7" in width, and 2 to 6 feet in depth, was not conducted by a competent person.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  (a)     At 935 Montlimar Drive (Behind the building/East side): On October 20, 2015, and at times prior, the employer exposed employees to cave in hazards in that employees were allowed to work in the southeast corner of the excavation at a depth of greater than 5 feet deep that was dug in class "b",  or previously disturbed soil.  The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one horizontal to one vertical (45 degrees measured from the horizontal).

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that posed a hazard by falling or rolling into excavations and protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  (a)     At 935 Montlimar Drive (Behind the building/East side): On October 20, 2015, and at times prior, the employer exposed employees to cave in hazards in that employees were allowed to work in the southeast corner of the excavation at a depth of greater than 5 feet where the spoil pile was placed directly on the edge of the excavation which could cause material to fall or roll into the excavation injuring employees.
