29 CFR 1926.652(c)(2)(ii): Deviation from the specifications, recommendations, and limitations issued or made by the manufacturer were allowed without the manufacturer's specific written approval: a) On or about October 19, 2015, without having manufacturer's specific written approval, hydraulic shoring was installed with multiple pieces of wood blocking shims stacked between the hydraulic shores and steel road plates as part of a trench support system in a trench having a depth of approximately 20 feet. b) On or about October 19, 2015, without manufacturer's specific written approval, hydraulic shoring was installed upside down between steel road plates as part of a trench support system in a trench having a depth of approximately 20 feet. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

After that time this data may be stored off the jobsite, but a copy was not made available to the Secretary upon request: a) On or about October 19, 2015, manufacturer specifications for Milwaukee Tool Trench Braces (screw jacks) installed as part of a trench support system constructed in a trench having a depth of approximately 20 feet were not available at the jobsite in written form during construction of the protective system, or made available to the Secretary upon request thereafter. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
